Lyudmila-Pharm LLC was suspected of causing losses to the state budget by 1.26 billion hryvnias by raising prices for medicines. The prices at which the officials of one of the largest distributors of pharmaceutical products supplied medicines ordered by the Ministry of Health were inflated by 20-40%.

In order to implement such a scheme, deliberately false information was entered into the documents, the presence of which is mandatory for the customs clearance of goods.

Thus, officials of the Ministry of Health indulged the manufacturers, who received super profits in 2012-2014, bypassing the 10% marginal markup on wholesale prices for medicines established by law.

"Lyudmila-Pharm" together with other major contractors of the Ministry of Health worked according to the following scheme:

  • when an agreement was drawn up between the manufacturer and the importer, only the established price for medicines was indicated, which then appeared in all customs documents and was registered by the State Inspectorate for Prices. Thus, in fact, such a price is "fair", which, if requested by law enforcement officers, can be confirmed by the manufacturer;
  • second condition – "credit note". Thus, the manufacturer provides the importing company as a large buyer with an impressive discount of 20-40% of the amount of the main order. Thus, the MOH supplier receives at least a 30% markup instead of 10%.
